The Office of the Clerk is historical in its tradition serving as a direct link between the residents and their local government.  The role of the Municipal Clerk is very diverse serving all levels of government, that state legislation was enacted to define the “Core duties” of the statutory office.

The Municipal Clerk serves as:

  • Secretary of the Municipal Corporation: custodian of the Municipal Corporation and custodian of the Municipal Seal and all minutes, books, deed, bonds, contracts and archival records of the municipal corporation.

  • Acts as Secretary to the Governing Body: prepares meeting agendas, be present at the meetings of the governing body, keep a journal of the proceeding of every meeting, retain the original copies of all ordinance and resolutions and record the minutes of every meeting.

  • Chief Administrative Officer: in all elections held in the municipality subject to the requirements of Title 19 of the Revised Statutes.

  • Chief Registrar of Voters: in the municipality, subject to the requirement of Title 19 of the Revised Statutes.

  • Administrative Officer for Licenses and Permits: responsible for the acceptance of application for licenses and permits and the issuance of licenses and permits, except where statute or municipal ordinance has delegated that responsibility to some other officer.

  • Coordinator and records manager: responsible for implementing local archives and records retention programs as mandated by Title 47 of the Revised Statutes.

  • Custodian of Record: pursuant to the Open Public Records Act.

TO APPLY FOR A MARRIAGE LICENSE:

  • If you are applying for a marriage license and a resident of New Jersey, the license may be obtained from the Registrar of Vital Statistics in either municipality that the bride or groom resides in.  If the bride is a non-resident, then the license is obtained in the municipality where the groom resides.  If both are non-residents of New Jersey, the license would be obtained in the municipality in which you will be getting married in. 
  • The application is filed together with the bride and groom and one (1) witness over the age of 18. There is a three (3) day waiting period for the license to be issued and once issued, it is valid for thirty (30) days. The license fee is $28.00.

  • Proof of identification is required and can be in the form of a birth certificate, driver license, and passport.  If one or both of the applicants are divorced, please bring a copy of the final decree with dates of judgment.  Death certificates are also required should that be the case.  If the applicant is under the age of 18 years of age, consent of both parents is necessary.  Both parental consents and judicial approval of such consents are necessary if the applicant is younger than 16.

  • Please be advised that the applicants must know both parents names (including mothers’ maiden name) and birth places and the name and address of the person officiating the marriage.

  • Certified copies of the marriage may be obtained from the registrar in the municipality where the ceremony occurred.  The fee per copy is $5.00.  Please make your check payable to:  The Borough of Hamburg.

  • Please be advised that there are two (2) golf courses that have Hamburg addresses:  Crystal Springs and Ballyowen.  These are popular locations for weddings but are not located in The Borough of Hamburg, but rather in Hardyston Township.  If you are getting married at either one of these locations, please contact the Hardyston Town Hall at 973-823-7020 should you need to apply for your marriage license.  Also advise either Crystal Springs or Ballyowen to forward your license to Hardyston Township at the end of your ceremony. 

TO OBTAIN A CERTIFIED COPY OF A VITAL RECORD:

  • As per State of New Jersey Executive Order #18, ALL applicants MUST provide proof of identity and relationship, (this includes police, attorneys, and funeral directors)

  • All applicants must be 18 years of age or older, with the exception of a female under the age of 18 who has given birth to a child, is permitted to obtain a copy of her child’s birth certificate.

  • Applicants must complete and sign the application providing current address, proof of identity, and proof of relationship.  Since special situations may apply, please call our office at 973-827-9230 X 13 for information.

  • Please complete the top portion of the application and only the section you wish to receive a record for.

  • For mail in applications:  CLEAR copies of documents to be submitted are required. 

  • Proof of identity:

    ONLY the following people are allowed to make a request for a Vital Statistic record:

    Subject, subject’s parent, legal guardian, subject’s spouse, subject’s civil union partner / domestic partner, subject’s child, subject’s grandchild, subject’s sibling

  • Acceptable Forms of Primary Identification:

    A current, valid US photo driver’s license showing current address OR a current, valid US driver’s license without a photo and one alternate form of ID with a current address.

     

    If you do not have a driver’s license as indicated above, then you will need two of the following alternate forms of identification:

                Vehicle registration, vehicle insurance card, passport, voter registration card, green card/immigrant visa, federal/county ID, school ID, W-2 for current/previous year or utility bill/bank statement from within the last 90 days.

    ALL ID MUST BE CURRENT AND NOT EXPIRED.

  • PO Boxes are not acceptable addresses and ID must show current physical address.

 **Please note that if your last name is different from the person you are requesting the vital record for, you must present documentation to establish your relationship to that person, i.e. Marriage certificate.  Please call our office if you need further information.

June 3        Last day to apply in person for a Vote-by-Mail Ballot for the Primary Election at the Sussex County Clerk's Office

June 4        Primary Election Day - Polls open at 6 am to 8 pm

VOTER REGISTRATION

To register to vote in Hamburg, New Jersey you must be a United States citizen, must be 18 years old by the next election and you must be a resident of Sussex County for 30 days before the election.

 

Registration Deadline Dates

You may register to vote any time you wish however to be eligible to vote in an upcoming election there is a registration deadline of 21 days prior to the election day.

 

Registration Forms

Applications for voter registration can be obtained from the New Jersey Division of Election, the Commissioner of Registration office in Sussex County or the Hamburg Municipal Clerk.  Registration forms are also available in various
State agencies such as the Division of Motor Vehicle. You may also print a registration application from the link below, after entering the required information, mail it to the Sussex County Commission of Voter Registration office at 18 Church Street, Newton, NJ 07860

 

What if I change my name or move?

The Voter Registration From can be used for either first time voter registration, or to report a name Change and or Address Change information.  If you move from one county of New Jersey to another, you must re-register to vote within the registration deadline in order to be eligible to vote in your new county.

Can I fax or email my voter registration form?

No. The Commission of Registration cannot accept faxed copies or electronic transmission of a voter registration form since an original signature is required.

 

Who Is Not Eligible for Voter Registration?

A person is not eligible to register to vote if he/she is serving a sentence or on parole or probation, as a result of a conviction of an indictable offense under state and federal law or if the person has been adjudged mentally incompetent.
